I would suggest:

The current president at the time of claim creation, Donald J Trump, either wins a majority of the 2020 presidential election electoral college votes, or

He gets a tie in the number of electoral college votes and remains president on 1 Feb 2021 and there is no remaining legal challenge that might remove him as president during his second term.

While these Electoral College votes are expected to be counted during during a joint session of congress on January 6th, the precise timing when it is finally decided how many Electoral College votes were won will not have any effect on the claim.

Not bad, but if there is an ongoing bitter dispute, I think it better to wait for final decision. Chances of either party finding someone else named Donald J Trump must be pretty slim, but may as well make sure.
